The following terms and conditions are written in English and can be downloaded and printed by the user. They can be requested in digital or written form from Gleitschirm Direkt, Wasserkuppe 46, 36129 Gersfeld or info@gleitschirm-direkt.de. Additionally, they will be handed out to each customer with every purchase.

The legal address of the Gleitschirm Direkt GmbH as well as the authorized representatives of the Gleitschirm Direkt GmbH can be seen in the invoice.

 

 1. Validity

These terms and conditions apply to all contracts, deliveries and services of Gleitschirm Direkt GmbH, for whatever object, insofar as the contractor has received these Terms and Conditions. Moreover, they remain valid for any other future business relationship without further explicit reference, once they became the contractual basis.

 

2. Conclusion of the contract

Contracts on this portal can only be closed in the German language.

You make a binding offer for the Gleitschirm Direkt GmbH if you have gone through the online ordering process by entering the information required there and clicked on the "Order now" button. After you have submitted your order, we will send you an e-mail confirming the receipt of your order and its details (acknowledgment of receipt). This acknowledgment does not constitute acceptance of your offer but shall only inform you that your order is received.

The contract is only concluded by sending the ordered goods.

The offers at the website of Gleitschirm Direkt GmbH are subject to change. Thus, the Gleitschirm Direkt GmbH is not obliged to deliver in case of unavailability of the goods. The contract for the individual services is binding, if the Gleitschirm Direkt GmbH has confirmed the order of the customer in written form.

The Gleitschirm Direkt GmbH is entitled to deliver the same quality and price, if the goods ordered are not available and the customer has given his/her consent to this procedure in the ordering form. If the customer does not agree with that product, he/she may withdraw from the contract and demand compensation of wasted expenditure according to his/her own discretion.

4. Storage of contract

Your order information is stored in our office. If you want this in print, you can print the "Order Confirmation". It appears on your screen after you have sent the order. If you have given us your e-mail address, you will also receive all the relevant details of your order by e- mail, which can also be printed.

 

5. Product selection

As a customer you have the option to select and order products on our website.

There is a separate product description for each product on the corresponding website. The customer can select the desired products on the website. These are collected in a virtual shopping cart and at the end of his purchase, the customer gets an assortment of products with the total final price, including tax.

 Before sending the order, Gleitschirm Direkt GmbH allows the customer to check the order for its accuracy, especially price and quantity, and correct it if necessary.

 

6. Return policy

You can return the goods within 14 days without stating any reasons. The time limit begins after receipt of this instruction in written form (e.g. letter, fax, e - mail), but not before receipt of the goods by the recipient (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also not before we fulfilled our information obligations under Article 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB or our other obligations according to § 312e paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 BGB. 

Only if the package cannot be shipped (e.g. bulky goods) you may return using the withdrawal explanatory text form. It is sufficient to send the goods or the withdrawal request within the revocation period. In any case, the return is at our expense and risk. The return or the return request must be sent to:

Consequences of return

In the case of an effective return the mutually received benefits are to be refunded. In case of deterioration of the good and benefits (e.g. benefits of use), which partially cannot be returned or can only be returned in a deteriorated condition or not at all, you have to pay us compensation. For the deterioration and derived benefits, you must pay compensation only to the extent the use or the deterioration is due to using the good, beyond testing its properties and functioning. "Testing the properties and functioning" refers to the testing of the goods, as it is possible and customary in a retail store. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of the goods.

7. Prices

All prices are in Euro, including 19 %VAT plus applicable cost of packaging and shipping.

 

8. Execution of the contract

 

Processing of orders

We will process orders within 72 hours and notify the customer, if the products you want are available.

 

Delivery

As far as the ordered products are available, we will ship within 3 days after receipt of payment. Out of stock goods will be sent to you as soon as possible.

 

Shipping costs 

You usually pay a shipping and handling fee of € 6,90 which only partially covers the costs of postage, the rest is paid by Gleitschirm Direkt GmbH. In exceptional cases we have a higher postage fee. This is reported accordingly. If for technical or logistical reasons a shipment is in several stages, we will charge the shipping fee only once. For shipments abroad, shipping costs are calculated in the amount of the costs incurred.

 

Changes, extensions, limitations of the order

Gleitschirm Direkt GmbH will answer the customer queries related to previously placed orders with respect to changes, extensions and/or limitations of the product scope in the short term. If the customer wants a product modification, extension and/or limitation up to 5 working days before the scheduled delivery, it will be taken into account by Gleitschirm Direkt GmbH if possible.

 

9. Service Hotline

Gleitschirm Direkt GmbH provides a telephone number to answer any questions the customer has in connection with the products. This hotline is available to the customer 5 days a week (Monday to Friday except holidays) during normal business hours (09:00 - 17:00).

 

10. Warranty and Liability

If the delivered items have obvious material or manufacturing defects, which also include transport damages, please report such defects immediately to us. The failure of this complaint, however, has no consequences for your legal rights.

For defective products, the customer will send the product at the cost of Gleitschirm-Direkt GmbH.

The warranty Gleitschirm-Direkt GmbH offers is subject to the statutory provisions, in particular of § 433 ff BGB. In business transactions, the guarantee is limited to 1 year and Gleitschirm-Direkt GmbH is entitled to repair the product or to replace it free of charge.

 

Gleitschirm-Direkt GmbH is liable

  • in full amount of damages for gross negligence of its directors and officers,
  • for any violation of essential contractual obligations,
  • in the amount of the last two cases on payment of typical, foreseeable damage.

Contributory negligence of the customer will be at his expense.

The liability due to intent, warranty, malice and for personal injury as well as under the Product Liability Act remains unaffected.

 

11. Retention of title

Until full payment, the goods remain the property of Gleitschirm-Direkt GmbH.

 

12. Payment, due date, late payment

Gleitschirm-Direkt GmbH provides the customer a bill for the ordered goods, which is handed to him/her with the delivery of the goods. Gleitschirm-Direkt GmbH accepts payment in advance, cash on delivery or invoice. Advance payment or settlement by credit card are included in the invoice.

For delivery against invoice you have to pay the invoice within 14 days of receipt of the goods. Please use the accompanying remittance slip, which is included in the invoice. If you do not have the accompanying remittance slip, please transfer the amount due to the following bank account, quoting the invoice number: Gleitschirm-Direkt GmbH, Sparkasse Fulda , Account No: 6006668 ; BLZ 53050180. 

Prices shown on the bill are always retail prices including VAT.

In case of payment default the customer is obliged to pay interest at the rate of 5 % above the base rate of the Gleitschirm-Direkt GmbH, unless the Gleitschirm-Direkt GmbH can prove a higher interest rate. For customers, who are entrepreneurs, sentence 1 applies with the proviso that the default interest rate is 8 % points above the base rate.

 

13. Force Majeure

In the event that Gleitschirm-Direkt GmbH can not provide the ordered goods due to force majeure (including war, natural disasters), it is released of their performance obligations for the duration of the hindrance. If it is impossible for Gleitschirm-Direkt GmbH to execute the order or delivery of the goods for longer than one month due to force majeure, the customer is entitled to withdraw from the contract.
